Compelled by recent public and politicized cases in which withdrawal of nutrition and hydration were at issue, this essay examines recent Church statements and argues that the distinction between private and public forms of human life is being lost. Effacing the distinction between the sphere of the home (oikos), where the maintenance of life (zoē) occurs, and the city (polis), where political and public life (bios) occurs, may have unforeseen and unwanted consequences. Through their well-intentioned efforts to preserve the sanctity (...) of life, certain bishops and the Congregation for the Doctrine of the Faith have unfortunately brought political considerations into the home, taking decision-making authority away from those most intimately related to the patient. Thus, the question of removing nutrition and hydration in the case of patients such as Schiavo and Englaro becomes politicized and abstract, in contrast with the Church's previous positions on the importance of proportionate means in the maintenance of life, local decision making, and its recognition of life as a penultimate end. The National Conference of Catholic Bishops has argued for significant government involvement in health care in order to assure respect for what they regard as the right to health care. Critics charge that the bishops are wrong because health care is not a right. In this article, it is argued that these critics are correct in their claim that health care is not a right. However, it is also argued that the premise that health care is not a right does (...) not imply that the market is the most equitable and just system for providing health care. Natural law arguments in the tradition of Roman Catholic social teaching lead to the conclusion that a just and prosperous society has a moral obligation to provide health care even if there is no such right. Further, there are strong moral grounds for concluding that the bishops are correct in their claim that health care ought not to be considered a market commodity. It is argued that if health care ought not to be considered a commodity, then national health insurance is the best available alternative for fulfilling the social obligation to distribute health care resources justly and fairly at this time in American history. The bishops' case for government involvement can be made on the strength of the Catholic tradition in theological argumentation, independent of the claim that health care is a right. (shrink)

Francis Cardinal George, one of the great theologian bishops of the American episcopate, issued a letter on a piece of pending legislation in the state of Illinois. The focus of the letter was on the teaching of the natural law, and why adherence to the natural law required opposition to the proposed legislation. In response, a well-known law professor at a prestigious secular [End Page 710] law school in the state wrote a public response for an online political website. The focus of his argument was to criticize the notion of natural law according to his understanding of the teaching of St. Thomas Aquinas. It is not necessary to describe the details of his argument, other than to say it tended to understand natural law as mere naturalism that evinced a fairly glaring misreading of the Angelic Doctor. That is, the secular legal scholar argued, in essence, that since the activity in question was observable by animals in nature, that it was therefore part of the natural law, and could be defended as a right. To this, a Thomistic sed contra is perhaps the most fitting response.As this story makes clear, there is a great ignorance of what constitutes the natural law in the secular consciousness, even among the most respected of secular legal scholars, to say nothing of the application of the natural law to the juridic world of law and politics. Perhaps the last hurrah of natural law, at least in the American public consciousness, was then Sen. Joseph Biden’s famous grilling of Supreme Court nominee Clarence Thomas on the subject in 1991. Since then, legal positivism has become nearly universal, divorcing legal norms from any realistic understanding of a common human nature. It has become the dominant ideology in America’s legal academies, even if some adherents of natural law remain in positions of authority in the judicial system.Although it has faded from the world of secular law in the United States, the tradition of natural law has retained a firm hold in Catholic thought, especially by that religious order dedicated to the teachings of its most brilliant adherent, St. Thomas. Not only Thomistic natural law, but proponents of the so-called new natural law continue to provide a vibrant source of debate and insight into the understanding of the natural law in evaluating the goodness of human action. Pope John Paul II’s famous encyclical Veritatis Splendor represents the magisterial commitment to the natural law approach in moral thinking, even if some might believe that commitment has weakened in recent years.To a lesser degree, there has remained a strong current of natural law thinking within the currents of legal philosophy in canon law, even if the precise connection between natural law and its juridic instantiation has not always been the focus. Among recent ecclesiastical legal theorists, arguably the most influential proponent of a robust natural law approach to legal philosophy was the Spanish canonist Javier Hervada Xiberta, and especially his Introducción crítica al derecho natural, currently in its tenth Spanish edition. A disciple of Jose Maria Escriva’s Opus Dei movement, Hervada was a long-serving and internationally respected dean of the School of Law in Navarre. Through his teaching and the various journals he founded, he insisted on the link between law and justice—lex and ius. The two books under review, though intended for a general readership, are indications that interest in these matters is very much alive.Riegert and Moore preface their selection of texts with the story of Bishop Aleben (A-lo-pen), who travelled the Silk Road from Persia and was received with honour at the imperial capital of Xian (Chang-an) at the beginning of the Tang dynasty (635 CE). The emperor Taizong was sympathetic to what he called the "Luminous Religion," a Nestorian version of Christianity, possibly in Syriac, as presented by Aleben. It seems that these teachings were translated into Chinese in the form of sutras. One of them, preserved in stone as the Monument Sutra, features the cross rising from the lotus, the symbol chosen by Karl Reichelt for Tao-fung Shan, his Christian center in Buddhist style at Sha-tin outside Hong Kong, many centuries later. Thousands of Buddhist texts were preserved in the library cave at Dunhuang monastery, about one thousand miles west of Xian, where they were rediscovered by the Taoist priest Wang Yuanlu, who arrived there in the 1890s and became the self-appointed guardian of the scrolls.Included in this treasure trove were the Jesus Sutras, which are now scattered in museums and private collections, largely inaccessible to the public. But if the selection published here in a very elegant translation is anything to go by, they are [End Page 190] extremely significant religious documents with a spiritual value all their own. For the uninitiated, there is no way of checking the authenticity of these translations. The commentaries that accompany them could be slightly tendentious in that they nudge us in the direction of the editors' particular holistic worldview. But the texts themselves have a beauty and integrity that speaks for itself. They represent a Higher Dharma of perfect purity (p. 86), which, like a mirror, reflects the world with no trace of self: no desire, no action, no virtue, no truth (pp. 80–83, 126–129). The Jesus story is retold, and Jesus is portrayed as the teacher of this Higher Path. The sutras speak of One Spirit who is self-created, One God who is creator of the world, and One Lord, the Messiah who will return. There are prayers, too: "O Loving Father, Enlightened Son, Holy Spirit King"; "Lamb of Love and Bliss"; "O Holy Sage, Universal Lord, Messiah" (pp. 110–113). The texts obviously bear witness to a Buddhist-Christian dialogue much earlier and at a far deeper level than many would have thought possible. Now obedience to the commandments entails, in addition to a good motivation or a willingness to strive, the conformity of an action's object to the specifying content of the commandment. What is the significance of a commandment to honor one's father and mother, if it does not specify actions? The commandments of God (...) specify what kinds of action are, or are not, in conformity with the true good of man. In his analysis of the moral act, the Pope holds that the object of the act is "the primary and decisive element for moral judgment" (VS # 79). Actions which by the nature of their object are unable to be ordered to man's true end can never be "good" actions. Further, he notes that acts, even individual acts, are determinative of the goodness or badness of the person. These points are summarized nicely in the following passage: Activity is morally good when it attests to and expresses the voluntary ordering of the person to his ultimate end and the conformity of a concrete action with the human good as it is acknowledged in its truth by reason. Certain eminent Catholic moral theologians today dissent from Pope John Paul's teaching that " there exist acts which per se and in themselves, independently of circumstances, are always seriously wrong by reason of their object." In the face of this dissent, John Finnis has produced a powerful philosophical and theological defense of the papal teaching. Moral Absolutes presents the 1988 Michael J. Sosa’s topic is the use of intuitions in philosophy. Much of what I have written on the issue has been critical of appeals to intuition in epistemology, though in recent years I have become increasingly skeptical of the use of intuitions in ethics and in semantic theory as well.

Wikipedia is a free encyclopedia that is written and edited entirely by visitors to its website. I argue that we are misled when we think of it in the same epistemic category with traditional general encyclopedias. An empirical assessment of its reliability reveals that it varies widely from topic to topic. So any particular claim found in it cannot be relied on based on its source. I survey some methods that we use in assessing specific claims and argue that the (...) structure of the Wikipedia frustrates them. (shrink)

The Argument from Inductive Risk (AIR) is taken to show that values are inevitably involved in making judgements or forming beliefs. After reviewing this conclusion, I pose cases which are prima facie counterexamples: the unreflective application of conventions, use of black-boxed instruments, reliance on opaque algorithms, and unskilled observation reports. These cases are counterexamples to the AIR posed in ethical terms as a matter of personal values. Nevertheless, it need not be understood in those terms. The values which load a (...) theory choice may be those of institutions or past actors. This means that the challenge of responsibly handling inductive risk is not merely an ethical issue, but is also social, political, and historical. (shrink)

There is a history of thinking that photographs provide a special kind of access to the objects depicted in them, beyond the access that would be provided by a painting or drawing. What is included in the photograph does not depend on the photographer’s beliefs about what is in front of the camera. This feature leads Kendall Walton to argue that photographs literally allow us to see the objects which appear in them. Current generative algorithms produce images in response to (...) users’ text prompts. Depending on the parameters, the output can resemble specific people or things which are named in the prompt. This resemblance does not depend on the user’s beliefs, so generated images are in this sense like photographs. Given this parallel, how should we think about AI-generated images? (shrink)

We show that the set of ultimately true sentences in Hartry Field's Revenge-immune solution model to the semantic paradoxes is recursively isomorphic to the set of stably true sentences obtained in Hans Herzberger's revision sequence starting from the null hypothesis. We further remark that this shows that a substantial subsystem of second-order number theory is needed to establish the semantic values of sentences in Field's relative consistency proof of his theory over the ground model of the standard natural numbers: -CA0 (...) (second-order number theory with a -comprehension axiom scheme) is insufficient. We briefly consider his claim to have produced a solution to the semantic paradoxes by introducing this conditional. A considerable literature has grown up around the claim of Uniqueness, according to which evidence rationally determines belief. It is opposed to Permissivism, according to which evidence underdetermines belief. This paper highlights an overlooked third possibility, according to which there is no rational doxastic attitude. I call this 'Nihilism'. I argue that adherents of the other two positions ought to reject it but that it might, nevertheless, obtain at least sometimes.

We show how in the hierarchies${F_\alpha }$of Fieldian truth sets, and Herzberger’s${H_\alpha }$revision sequence starting from any hypothesis for${F_0}$ that essentially each${H_\alpha }$ carries within it a history of the whole prior revision process.As applications we provide a precise representation for, and a calculation of the length of, possiblepath independent determinateness hierarchiesof Field’s construction with a binary conditional operator. We demonstrate the existence of generalized liar sentences, that can be considered as diagonalizing past the determinateness hierarchies definable in Field’s recent (...) models. The ‘defectiveness’ of such diagonal sentences necessarily cannot be classified by any of the determinateness predicates of the model. They are ‘ineffable liars’. Thomas Reid is often misread as defending common sense, if at all, only by relying on illicit premises about God or our natural faculties. On these theological or reliabilist misreadings, Reid makes common sense assertions where he cannot give arguments. This paper attempts to untangle Reid's defense of common sense by distinguishing four arguments: (a) the argument from madness, (b) the argument from natural faculties, (c) the argument from impotence, and (d) the argument from practical commitment. Of these, (a) and (...) (c) do rely on problematic premises that are no more secure than claims of common sense itself. Yet (b) and (d) do not. This conclusion can be established directly by considering the arguments informally, but one might still worry that there is an implicit premise in them. In order to address this concern, I reconstruct the arguments in the framework of subjective Bayesianism. The worry becomes this: Do the arguments rely on specific values for the prior probability of some premises? Reid's appeals to our prior cognitive and practical commitments do not. Rather than relying on specific probability assignments, they draw on things that are part of the Bayesian framework itself, such as the nature of observation and the connection between belief and action. Contra the theological or reliabilist readings, the defense of common sense does not require indefensible premises. (shrink)

Background theories in science are used both to prove and to disprove that theory choice is underdetermined by data. The alleged proof appeals to the fact that experiments to decide between theories typically require auxiliary assumptions from other theories. If this generates a kind of underdetermination, it shows that standards of scientific inference are fallible and must be appropriately contextualized. The alleged disproof appeals to the possibility of suitable background theories to show that no theory choice can be timelessly or (...) noncontextually underdetermined: Foreground theories might be distinguished against different backgrounds. Philosophers have often replied to such a disproof by focussing their attention not on theories but on Total Sciences. If empirically equivalent Total Sciences were at stake, then there would be no background against which they could be differentiated. I offer several reasons to think that Total Science is a philosophers' fiction. No respectable underdetermination can be based on it. (shrink)

Experimental evidence strongly supports the view that the subdivision of organ anlagen into smaller structural units is an autonomous process. Dalcq &Pasteels' hypothesis which says that the boundaries between the different areas into which a morphogenetic field differentiates are determined by “Threshold values” in the “potential” of the field in question, is inconsistent with our present knowledge of biochemical reaction systems. Threshold values may only be used indescribing the spatial differentiation of a morphogenetic field. It is suggested that the latter (...) concept be replaced by the concept of “optimal values” in the intensity of a morphogenetic field-specific for the various chemo-differentiations characterizing the different regions into which a morphogenetic field will split up-and that each optimal value isdeterminative for the appearance of one particular differentiation within the morphogenetic field, each differentiation being formed within a certain range of intensity of the field. On the basis of the hypothesis formulated above a “virginal” morphogenetic field will necessarily differentiate into a number of smaller fields of second order, which in their turn will split up into fields of third order, etc. ” Pattern formation” may be defined as the differentiation of a morphogenetic field into an increasing number of smaller fields of higher order of qualitative different chemical and structural composition. Since differentiation of a morphogenetic field proceeds autonomously, the capacity for pattern formation is an intrinsic property of a morphogenetic field. In the light of these considerations it is suggested that a morphogenetic field action is responsible for the first differentiation of the developing embryo into regions with predominantly ectodermal, mesodermal or endodermal differentiation tendencies. The present knowledge about the characteristic pattern formation taking place in the axial mesoderm as well as in the overlying neural plate seems to be in good agreement with the implications of the present morphogenetic field concept. It is emphasized, however, that if the present morphogenetic field concept cannot be characterized further biochemically and biophysically, it will have to be replaced by another concept which can be defined more sharply and is more easily accessible to experimental analysis. Die Hypothese vonDalcq &Pasteels , dass die Grenzen zwischen den unterschiedenen Gebieten, in denen ein morphogenetisches Feld sich differenziert, durch “Schwellenwerte” im “Potential” des genannten Feldes bestimmt werden, ist unvereinbar mit unserem heutigen Wissen über biochemischen Reaktionssystemen. Der Gebrauch des Begriffs “Schwellenwert” ist nur gestattet bei der Beschreibung der räumlichen Differenzierung eines morphogenetischen Feldes. Statt dieses Begriffs wird der Begriff “Optimaler Wert” vorgeschlagen; Werte also in der Intensität eines morphogenetischen Feldes, optimal und spezifisch für die verschiedene Chemodifferenzierungen, welche die Gebiete kennzeichnen, in denen ein morphogenetisches Feld sich differenzieren wird. Jeder optimaler Wert soll dann das Erscheinen einer bestimmten Differenzierung innerhalb des morphogenetischen Feldes veranlassen, welche Differenzierung sich bildet innerhalb eines bestimmten Bereichs der Feldintensität. Auf Grund der obigen Hypothese wird ein “virginelles” morphogenetisches Feld zwangsläufig sich differenzieren in eine Anzahl kleinerer Feldern zweiten Grades; diese in Felder dritten Grades, usw. Musterbildung könnte definiert werden als die Differenzierung eines morphogenetischen Feldes in eine zunehmende Anzahl kleinerer Felder höheren Grades von qualitativ verschiedener chemischen und strukturellen Zusammensetzung, Weil diese Differenzierung autonom vor sich geht, ist das Vermögen zur Musterbildung eine innewohnende Eigenschaft eines morphogenetischen Feldes. Im Lichte dieser Betrachtungen ist es naheliegend anzunehmen dass eine morphogenetische Feldwirkung verantwortlich ist für die erste Differenzierung des sich entwickelnden Embryos in Gebiete überwiegend ektodermalen, mesodermalen oder entodermalen Differenzierungstendenzen. Die heutigen Kenntnisse über die charakteristische Musterbildung im axialen Teil des Mesoderms und in der überliegenden Neuralplatte scheinen in guter Übereinstimmung zu sein mit den des morphogenetischen Feldbegriffs. Dennoch wird benachdruckt, dass, falls das gegenwärtige morphogenetische Feldbegriff nicht weiter biochemisch und biophysisch gekennzeichnet werden kann, anstatt dessen ein anderer Begriff entwickelt werden muß, der schärfer definiert werden kann und besser zugänglich ist für experimentelle Analyse. We consider various concepts associated with the revision theory of truth of Gupta and Belnap. We categorize the notions definable using their theory of circular definitions as those notions universally definable over the next stable set. We give a simplified account of varied revision sequences-as a generalised algorithmic theory of truth. This enables something of a unification with the Kripkean theory of truth using supervaluation schemes.

We characterise explicitly the decidable predicates on integers of Infinite Time Turing machines, in terms of admissibility theory and the constructible hierarchy. We do this by pinning down ζ, the least ordinal not the length of any eventual output of an Infinite Time Turing machine (halting or otherwise); using this the Infinite Time Turing Degrees are considered, and it is shown how the jump operator coincides with the production of mastercodes for the constructible hierarchy; further that the natural ordinals associated (...) with the jump operator satisfy a Spector criterion, and correspond to the L ζ -stables. It also implies that the machines devised are "Σ 2 Complete" amongst all such other possible machines. It is shown that least upper bounds of an "eventual jump" hierarchy exist on an initial segment. Some philosophers understand natural kinds to be the categories which are constraints on enquiry. In order to elaborate the metaphysics appropriate to such an account, I consider the complicated history of scurvy, citrus, and vitamin C. It may be tempting to understand these categories in a shallow way (as mere property clusters) or in a deep way (as fundamental properties). Neither approach is adequate, and the case instead calls for middle-range ontology: starting from categories which we identify in the world (...) and elaborating their structure, but not pretending to jump ahead to a complete story about fundamental being.
